Po dobu platnosti opat\u0159en\u00ed nen\u00ed mo\u017en\u00e9 realizovat ani v\u00fdstavbu ale ani p\u0159estavbu. Nej\u010dast\u011bji je vyd\u00e1v\u00e1n\u00ed v obdob\u00ed pl\u00e1novan\u00e9 zm\u011bny \u00fazemn\u00edho pl\u00e1nu.<\/p>\n\n\n\n<p>V posledn\u00ed dob\u011b se s uz\u00e1v\u011brami m\u016f\u017eeme setkat nejv\u00edce ve st\u0159edo\u010desk\u00fdch obc\u00edch a to proto, \u017ee kv\u016fli <a href=\"https:\/\/www.homeportal.cz\/cs\/co-je-to-developerske-projekt-a-jake-jsou-jeho-faze\/\" title=\"\">realizaci developersk\u00fdch projekt\u016f<\/a>, masivn\u00ed v\u00fdstavb\u011b a celkov\u00e9mu rozmachu a rozvoji je m\u00edstn\u00ed <strong>infrastruktura <\/strong>p\u0159et\u00ed\u017een\u00e1. Tempo jej\u00edho rozvoje zaost\u00e1v\u00e1 za v\u00fdstavbou a nedostatek nap\u0159\u00edklad \u010disti\u010dek odpadn\u00edch vod, vzd\u011bl\u00e1vac\u00edch za\u0159\u00edzen\u00ed, dopravn\u00ed s\u00edt\u011b atp. je pot\u0159eba korigovat a zajistit v dostate\u010dn\u00e9 m\u00ed\u0159e.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-medium-font-size\"><strong>Jak to prob\u00edh\u00e1<\/strong><\/h2>\n\n\n\n<p>Obec nejprve navrhne zm\u011bnu \u00fazemn\u00edho pl\u00e1nu \u010di dokonce po\u0159\u00edzen\u00ed nov\u00e9ho. Rozhodne o zp\u016fsobu vyu\u017eit\u00ed pozemk\u016f. N\u011bkter\u00e9 m\u016f\u017ee ze stavebn\u00edch zm\u011bnit na nezastaviteln\u00e9, nap\u0159\u00edklad se z\u00e1m\u011brem osazen\u00ed ve\u0159ejnou zelen\u00ed. Rozpracuje se n\u00e1vrh pl\u00e1nu, kter\u00fd mohou komentovat dot\u010den\u00ed vlastn\u00edci \u010di org\u00e1ny. Jejich n\u00e1mitky jsou projedn\u00e1ny, pot\u00e9 vyd\u00e1 zastupitelstvo fin\u00e1ln\u00ed podobu. A pr\u00e1v\u011b v obdob\u00ed projedn\u00e1v\u00e1n\u00ed zm\u011bn, v p\u0159echodn\u00e9m obdob\u00ed je \u010dasto platn\u00e1 <strong>stavebn\u00ed uz\u00e1v\u011bra<\/strong> \u2013 dokud nejsou zm\u011bny definitivn\u011b schv\u00e1leny. <strong>Nejedn\u00e1 se tud\u00ed\u017e o \u017e\u00e1dnou permanentn\u00ed stavebn\u00ed restrikci<\/strong>, sp\u00ed\u0161e o ochranu pr\u00e1v vlastn\u00edk\u016f pozemk\u016f, dokud nen\u00ed jasn\u00e9, jestli se jich zm\u011bna \u00fazemn\u00edho pl\u00e1nu bezprost\u0159edn\u011b dotkne.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-medium-font-size\"><strong>Na co si d\u00e1t pozor<\/strong><\/h2>\n\n\n\n<p>Narazit m\u016f\u017eete, pokud se zrovna chyst\u00e1te koupit <strong>stavebn\u00ed pozemek<\/strong>. V\u017edy je proto p\u0159ed koup\u00ed vhodn\u00e9 kontaktovat m\u00edstn\u00ed <strong>stavebn\u00ed \u00fa\u0159ad<\/strong> a sezn\u00e1mit se s \u00fazemn\u00edm pl\u00e1nem. Ov\u011b\u0159it si, zda se na pozemku sm\u00ed stav\u011bt a zdali se ho net\u00fdk\u00e1 stavebn\u00ed uz\u00e1v\u011bra. O uz\u00e1v\u011brce je obec povinna informovat i na webu a na \u00fa\u0159edn\u00ed desce formou ve\u0159ejn\u00e9 vyhl\u00e1\u0161ky alespo\u0148 <strong>15 dn\u00ed dop\u0159edu<\/strong>, pot\u00e9 b\u011b\u017e\u00ed <strong>m\u011bs\u00ed\u010dn\u00ed lh\u016fta <\/strong>na pod\u00e1n\u00ed n\u00e1mitek a p\u0159ipom\u00ednek.<\/p>\n\n\n\n<p>V p\u0159\u00edpad\u011b vyhl\u00e1\u0161en\u00ed stavebn\u00ed uz\u00e1v\u011bry jste nuceni pl\u00e1novanou stavbu odlo\u017eit a\u017e o n\u011bkolik let (a to i kdy\u017e se jedn\u00e1 o rodinn\u00fd d\u016fm). Br\u00e1nit se t\u00e9m\u011b\u0159 nelze. Rozhodnut\u00ed o uz\u00e1v\u011b\u0159e je pln\u011b v kompetenci obce a m\u016f\u017ee b\u00fdt vzta\u017eena na cel\u00e9 jej\u00ed \u00fazem\u00ed. D\u011bje se tak i p\u0159esto, \u017ee dle stavebn\u00edho z\u00e1kona m\u00e1 b\u00fdt <strong>stavebn\u00ed \u010dinnost<\/strong> omezena jen v nezbytn\u00e9m rozsahu a nem\u011bla by b\u00fdt mo\u017enost omezit udr\u017eovac\u00ed pr\u00e1ce.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-medium-font-size\"><strong>Jak se br\u00e1nit?<\/strong><\/h2>\n\n\n\n<p>Obec m\u016f\u017ee \u017eadateli ud\u011blit v\u00fdjimku, neohro\u017euje-li \u00fa\u010del stavebn\u00ed uz\u00e1v\u011bry \u2013 ale proti jej\u00edmu zam\u00edtnut\u00ed se nelze odvolat. V pr\u016fb\u011bhu 30 denn\u00ed lh\u016fty m\u00e1te mo\u017enost vzn\u00e9st <strong>n\u00e1mitky a p\u0159ipom\u00ednky<\/strong>, kter\u00e9 je obec povinna vz\u00edt v potaz. Nane\u0161t\u011bst\u00ed, ve v\u011bt\u0161in\u011b p\u0159\u00edpad\u016f n\u00e1mitk\u00e1m neb\u00fdv\u00e1 vyhov\u011bno. Ani v tomto p\u0159\u00edpad\u011b se nelze odvolat. Potom u\u017e zb\u00fdv\u00e1 pouze \u017ealoba ke krajsk\u00e9mu soudu, z d\u016fvodu nez\u00e1konnosti stavebn\u00ed uz\u00e1v\u011bry nebo alespo\u0148 pod\u00e1n\u00ed podn\u011btu na p\u0159ezkum rozhodnut\u00ed o stavebn\u00ed uz\u00e1v\u011b\u0159e. Uk\u00e1\u017ee-li se podn\u011bt nebo \u017ealoba jako opodstatn\u011bn\u00e9, m\u00e1 <strong>vlastn\u00edk pozemku<\/strong> n\u00e1rok na n\u00e1hradu \u0161kody ze strany obce. Jen je nutn\u00e9 prok\u00e1zat zp\u016fsobenou \u0161koda, kter\u00e1 uz\u00e1v\u011brou vznikla.<\/p>\n\n\n\n<p>Pokud se v\u0161ak nechcete tr\u00e1pit s vy\u0159izov\u00e1n\u00edm stavebn\u00edho povolen\u00ed a riskovat, \u017ee si na nov\u00e9m pozemku kv\u016fli stavebn\u00ed uz\u00e1v\u011b\u0159e n\u011bkolik let nic nepostav\u00edte, m\u016f\u017eete si vybrat rodinn\u00fd d\u016fm z na\u0161\u00ed <a href=\"https:\/\/www.homeportal.cz\/cs\/nakup-nemovitosti\/?_sfm_item-typ=typ2&amp;_sfm_min_price=13250+50000000\" title=\"\">nab\u00eddky<\/a>, kter\u00fd je ji\u017e ve v\u00fdstavb\u011b a na\u0161i obchodn\u00edci V\u00e1m r\u00e1di pom\u016f\u017eou s jeho v\u00fdb\u011brem. <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Je to n\u00e1stroj, kter\u00fd umo\u017e\u0148uje obci na p\u0159echodn\u00e9 obdob\u00ed utlumit stavebn\u00ed \u010dinnost na sv\u00e9m \u00fazem\u00ed.
