Prod\u00e1vaj\u00edc\u00ed toti\u017e nese odpov\u011bdnost za skryt\u00e9 vady po dobu n\u011bkolika let ode dne, kdy jste <a href=\"https:\/\/www.homeportal.cz\/cs\/nakup-nemovitosti\/\" title=\"\">nemovitost koupili<\/a> (resp. p\u0159evzali), a mus\u00ed je bu\u010f odstranit, nebo V\u00e1m vr\u00e1tit pen\u00edze. V mez\u00edch z\u00e1kona je ale nutn\u00e9 postupovat spr\u00e1vn\u011b, aby byl n\u00e1rok uzn\u00e1n.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading has-medium-font-size\"><strong>Jak definovat skrytou vadu nemovitosti<\/strong><\/h2>\n\n\n\n<p>Za skrytou vadu se pova\u017euje takov\u00e1 vada, co existovala u\u017e v dob\u011b p\u0159evzet\u00ed nemovitosti, ale <strong>nebyla zjevn\u00e1 a vy\u0161la najevo a\u017e pozd\u011bji<\/strong>. M\u016f\u017ee se jednat nap\u0159\u00edklad o zespodu ztrouchniv\u011blou podlahu, a\u010dkoliv na povrchu vypad\u00e1 v po\u0159\u00e1dku, nebo o pl\u00edse\u0148 pod \u201edom\u00e1c\u00ed izolac\u00ed\u201c v podob\u011b polystyrenov\u00fdch desek nalepen\u00fdch na st\u011bn\u00e1ch.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-medium-font-size\"><strong>Do kdy prod\u00e1vaj\u00edc\u00ed ru\u010d\u00ed za skryt\u00e9 vady<\/strong><\/h2>\n\n\n\n<p>I kdy\u017e mus\u00ed prod\u00e1vaj\u00edc\u00ed za skryt\u00e9 vady na nemovitosti ru\u010dit, neplat\u00ed to nav\u017edy a lh\u016fta je p\u0159im\u011b\u0159en\u00e1. U novostaveb skryt\u00e1 vada prakticky nehroz\u00ed a u star\u0161\u00edch, pravideln\u011b udr\u017eovan\u00fdch a kontrolovan\u00fdch dom\u016f je pravd\u011bpodobnost n\u00edzk\u00e1. <strong>Kupuj\u00edc\u00ed m\u00e1 5 let na to, aby uplatnil n\u00e1rok na ozn\u00e1men\u00ed skryt\u00e9 vady<\/strong> a \u017e\u00e1dal jej\u00ed odstran\u011bn\u00ed nebo vr\u00e1cen\u00ed \u010d\u00e1sti kupn\u00ed ceny. Bude-li se do\u017eadovat pozd\u011bji, soud mu dle ustanoven\u00ed \u00a7 2129 NOZ nevyjde vst\u0159\u00edc.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Zn\u011bn\u00ed ustanoven\u00ed \u00a7 2129:<\/strong><\/h3>\n\n\n\n<p>(1)&nbsp;Kupuj\u00edc\u00ed m\u00e1 pr\u00e1vo na p\u0159im\u011b\u0159enou slevu z kupn\u00ed ceny, nem\u00e1-li pozemek v\u00fdm\u011bru ur\u010denou v kupn\u00ed smlouv\u011b. Nem\u00e1-li v\u0161ak pozemek v\u00fdm\u011bru zapsanou ve ve\u0159ejn\u00e9m seznamu, m\u00e1 kupuj\u00edc\u00ed pr\u00e1vo na p\u0159im\u011b\u0159enou slevu z kupn\u00ed ceny, jen bylo-li to ujedn\u00e1no.<\/p>\n\n\n\n<p>(2) Neozn\u00e1mil-li kupuj\u00edc\u00ed prod\u00e1vaj\u00edc\u00edmu skrytou vadu stavby spojen\u00e9 se zem\u00ed pevn\u00fdm z\u00e1kladem do p\u011bti let od nabyt\u00ed, soud kupuj\u00edc\u00edmu pr\u00e1vo z vadn\u00e9ho pln\u011bn\u00ed nep\u0159izn\u00e1, nam\u00edtne-li prod\u00e1vaj\u00edc\u00ed, \u017ee vada nebyla v\u010das ozn\u00e1mena. Prod\u00e1vaj\u00edc\u00ed v\u0161ak nem\u00e1 pr\u00e1vo na n\u00e1mitku, je-li vada d\u016fsledkem skute\u010dnosti, o kter\u00e9 prod\u00e1vaj\u00edc\u00ed v dob\u011b odevzd\u00e1n\u00ed v\u011bci v\u011bd\u011bl nebo musel v\u011bd\u011bt.<\/p>\n\n\n\n<p>V\u00edce se problematikou zab\u00fdv\u00e1 <a href=\"http:\/\/zakony.centrum.cz\/obcansky-zakonik-novy\/cast-4-hlava-2-dil-1-oddil-2-paragraf-2129\">paragraf \u00a7 2129<\/a> v Nov\u00e9m ob\u010dansk\u00e9m z\u00e1kon\u00edku.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-large\"><img decoding=\"async\" width=\"1024\" height=\"682\" src=\"https:\/\/www.homeportal.cz\/wp-content\/uploads\/2021\/02\/milivoj-kuhar-Te48TPzdcU8-unsplash-1024x682.jpg\" alt=\"\" class=\"wp-image-3704\" srcset=\"https:\/\/www.homeportal.cz\/wp-content\/uploads\/2021\/02\/milivoj-kuhar-Te48TPzdcU8-unsplash-1024x682.jpg 1024w, https:\/\/www.homeportal.cz\/wp-content\/uploads\/2021\/02\/milivoj-kuhar-Te48TPzdcU8-unsplash-300x200.jpg 300w, https:\/\/www.homeportal.cz\/wp-content\/uploads\/2021\/02\/milivoj-kuhar-Te48TPzdcU8-unsplash-768x511.jpg 768w, https:\/\/www.homeportal.cz\/wp-content\/uploads\/2021\/02\/milivoj-kuhar-Te48TPzdcU8-unsplash-1536x1022.jpg 1536w, https:\/\/www.homeportal.cz\/wp-content\/uploads\/2021\/02\/milivoj-kuhar-Te48TPzdcU8-unsplash.jpg 1920w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><\/figure><\/div>\n\n\n<h2 class=\"wp-block-heading has-medium-font-size\"><strong>Od\u0161kodn\u011bn\u00ed nelze \u017e\u00e1dat, pokud o z\u00e1vad\u011b v\u00edte<\/strong><\/h2>\n\n\n\n<p>Z\u00e1kon po\u010d\u00edt\u00e1 i s p\u0159\u00edpady, kdy m\u00e1 nemovitost n\u011bjakou vadu, s n\u00ed\u017e prod\u00e1vaj\u00edc\u00ed kupuj\u00edc\u00edho sezn\u00e1m\u00ed. T\u0159eba kdy\u017e jsou tr\u00e1my na p\u016fd\u011b ztrouchniv\u011bl\u00e9 a v dohledn\u00fdch letech tak evidentn\u011b budou po\u017eadovat v\u00fdm\u011bnu. <strong>Za<br>n\u00ed tak podle z\u00e1kona mus\u00ed platit nov\u00fd majitel<\/strong>, proto\u017ee byl s vadou obezn\u00e1men p\u0159i <a href=\"https:\/\/www.homeportal.cz\/cs\/nakup-nemovitosti\/\" title=\"\">koupi nemovitosti<\/a> a souhlasil s n\u00ed, co\u017e tak\u00e9 mus\u00ed b\u00fdt uvedeno ve smlouv\u011b.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-medium-font-size\"><strong>Co m\u016f\u017ee kupuj\u00edc\u00ed \u017e\u00e1dat, kdy\u017e objev\u00ed vadu<\/strong><\/h2>\n\n\n\n<p>Pokud se skryt\u00e1 vada na nemovitosti projev\u00ed, m\u011bl by se kupuj\u00edc\u00ed \u0159\u00eddit ustanoven\u00edmi \u00a7 2106 a \u00a7 2107 ob\u010dansk\u00e9ho z\u00e1kon\u00edku a nedostatek prod\u00e1vaj\u00edc\u00edmu ozn\u00e1mit. N\u00e1sledn\u011b se rozli\u0161uje, o jak z\u00e1va\u017enou vadu se<br>jedn\u00e1, a podle n\u00ed lze \u017e\u00e1dat kompenzaci. Pokud se d\u00e1 odstranit, pak kupuj\u00edc\u00ed m\u016f\u017ee po\u017eadovat odstran\u011bn\u00ed vady nebo p\u0159im\u011b\u0159enou slevu z kupn\u00ed ceny. Pokud je vada neodstraniteln\u00e1 kupuj\u00edc\u00ed m\u016f\u017ee po\u017eadovat p\u0159im\u011b\u0159enou slevu z kupn\u00ed ceny, nebo zcela odstoupit od kupn\u00ed smlouvy (prod\u00e1vaj\u00edc\u00ed by tedy musel vr\u00e1tit celou \u010d\u00e1stku). <\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Ustanoven\u00ed \u00a7 2106:<\/strong><\/h3>\n\n\n\n<p>(1) Je-li vadn\u00e9 pln\u011bn\u00ed podstatn\u00fdm poru\u0161en\u00edm smlouvy, m\u00e1 kupuj\u00edc\u00ed pr\u00e1vo<\/p>\n\n\n\n<p>a) na odstran\u011bn\u00ed vady dod\u00e1n\u00edm nov\u00e9 v\u011bci bez vady nebo dod\u00e1n\u00edm chyb\u011bj\u00edc\u00ed v\u011bci,<\/p>\n\n\n\n<p>b) na odstran\u011bn\u00ed vady opravou v\u011bci,<\/p>\n\n\n\n<p>c) na p\u0159im\u011b\u0159enou slevu z kupn\u00ed ceny, nebo<\/p>\n\n\n\n<p>d)&nbsp;odstoupit od smlouvy.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Ustanoven\u00ed \u00a7 2107:<\/strong><\/h3>\n\n\n\n<p>(1)&nbsp;Je-li vadn\u00e9 pln\u011bn\u00ed nepodstatn\u00fdm poru\u0161en\u00edm smlouvy, m\u00e1 kupuj\u00edc\u00ed pr\u00e1vo na odstran\u011bn\u00ed vady, anebo na p\u0159im\u011b\u0159enou slevu z kupn\u00ed ceny.<\/p>\n\n\n\n<p>(2)&nbsp;Dokud kupuj\u00edc\u00ed neuplatn\u00ed pr\u00e1vo na slevu z kupn\u00ed ceny nebo neodstoup\u00ed od smlouvy, m\u016f\u017ee prod\u00e1vaj\u00edc\u00ed dodat to, co chyb\u00ed, nebo odstranit pr\u00e1vn\u00ed vadu. Jin\u00e9 vady m\u016f\u017ee prod\u00e1vaj\u00edc\u00ed odstranit podle sv\u00e9 volby opravou v\u011bci nebo dod\u00e1n\u00edm nov\u00e9 v\u011bci; volba nesm\u00ed kupuj\u00edc\u00edmu zp\u016fsobit nep\u0159im\u011b\u0159en\u00e9 n\u00e1klady.<\/p>\n\n\n\n<p>(3) Neodstran\u00ed-li prod\u00e1vaj\u00edc\u00ed vadu v\u011bci v\u010das nebo vadu v\u011bci odm\u00edtne odstranit, m\u016f\u017ee kupuj\u00edc\u00ed po\u017eadovat slevu z kupn\u00ed ceny, anebo m\u016f\u017ee od smlouvy odstoupit. Provedenou volbu nem\u016f\u017ee kupuj\u00edc\u00ed zm\u011bnit bez souhlasu prod\u00e1vaj\u00edc\u00edho.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-medium-font-size\"><strong>Jak postupovat p\u0159i oznamov\u00e1n\u00ed skryt\u00e9 vady<\/strong><\/h2>\n\n\n\n<p>Objev\u00ed-li se na nemovitosti skryt\u00e1 z\u00e1vada, mus\u00ed to nov\u00fd majitel p\u0159edchoz\u00edmu p\u00edsemn\u011b ozn\u00e1mit, a to nejl\u00e9pe <strong>zasl\u00e1n\u00edm doporu\u010den\u00e9ho dopisu v\u010detn\u011b fotodokumentace<\/strong>. Jedn\u00e1-li se o rozs\u00e1hlej\u0161\u00ed \u0161kodu, je dobr\u00e9 p\u0159izvat odborn\u00edka, celou v\u011bc s n\u00edm zkonzultovat a nechat si vystavit potvrzen\u00ed o zji\u0161t\u011bn\u00e9m stavu. Nap\u0159\u00edklad Albatros Kbely nab\u00edz\u00ed dokonce prodlou\u017eenou z\u00e1ruku. <\/figcaption><\/figure>\n<\/figure>\n\n\n\n<h2 class=\"wp-block-heading has-medium-font-size\"><strong>Odpov\u011bdnost za skryt\u00e9 vady nelze vylou\u010dit<\/strong><\/h2>\n\n\n\n<p>Ve snaze zbavit se odpov\u011bdnosti uv\u00e1d\u00ed n\u011bkte\u0159\u00ed prodejci do smlouvy pas\u00e1\u017ee jako \u201e<em>kupuj\u00edc\u00ed byl sezn\u00e1men se stavem nemovitosti a p\u0159eb\u00edr\u00e1 ji tak do vlastn\u00edch rukou<\/em>&#8220; nebo &#8222;<em>prod\u00e1vaj\u00edc\u00ed se s kupuj\u00edc\u00edm dohodl, \u017ee kupuj\u00edc\u00ed nebude uplat\u0148ovat n\u00e1roky na od\u0161kodn\u00e9 v p\u0159\u00edpad\u011b, \u017ee se objev\u00ed skryt\u00e1 vada<\/em>&#8222;. Ani to ov\u0161em prod\u00e1vaj\u00edc\u00edmu nepom\u016f\u017ee, a i nad\u00e1le nese za skryt\u00e9 vady plnou odpov\u011bdnost.<\/p>\n\n\n\n<p>Jedinou mo\u017enost\u00ed, jak se skute\u010dn\u011b odpov\u011bdnosti zbavit, je p\u00edsemn\u00fd souhlas kupuj\u00edc\u00edho. V praxi se ud\u011bluje typicky v p\u0159\u00edpad\u011b, kdy je prod\u00e1v\u00e1na \u201eruina\u201c prakticky vhodn\u00e1 pouze k demolici, p\u0159\u00edpadn\u011b rozs\u00e1hl\u00e9 rekonstrukci.
